About these terms
These terms govern your use of emberslate, the TV and movie tracking app, and the emberslate pages on emberfoldlabs.com. By creating an account or using emberslate, you agree to them. If you do not agree, do not use the app.
How we handle your personal data is explained separately in our Privacy Policy at https://www.emberfoldlabs.com/emberslate/privacy.
Who we are
emberslate is provided by emberfold labs, operated by an individual based in India. In these terms, "we", "us" and "our" mean emberfold labs. You can contact us at hello@emberfoldlabs.com.
Who can use emberslate
You must be at least 13 years old to use emberslate. If you are under 18, or under the age of majority where you live, you may only use the app with the permission of a parent or legal guardian, who agrees to these terms on your behalf.
You may not use the app if we have previously removed your account for breaking these terms, or if using it would break the law that applies to you.
Your account
- Give accurate information when you sign up, and keep it up to date.
- Keep your sign-in details secure. You are responsible for activity on your account.
- Each account is for one person. Do not share it, sell it or transfer it.
- Do not choose a username or display name that impersonates someone else or misleads people about who you are.
Tell us at hello@emberfoldlabs.com straight away if you think someone else has accessed your account.
Your content
emberslate lets you write posts and replies, leave reactions and likes, mention other people, send recommendations with notes, and submit reports. Everything you add is your content, and you keep ownership of it.
So that we can run the service, you give us a non-exclusive, worldwide, royalty-free licence to host, store, copy and display your content within the app, to the audiences you choose. The licence ends when you delete the content or your account, except for residual backup copies described in the Privacy Policy.
You are responsible for what you post, and you confirm that you have the right to post it.
Community rules
When you use community features, you must not post or share anything that:
- Is unlawful, or promotes or encourages illegal activity.
- Harasses, bullies, threatens, or intimidates anyone, or reveals their private information.
- Is hateful or discriminatory on the basis of race, ethnicity, religion, caste, gender, sexual orientation, disability or similar characteristics.
- Is sexually explicit, obscene, or harmful to children.
- Promotes violence, self-harm, or terrorism.
- Infringes someone else's copyright, trademark, privacy or other rights.
- Impersonates a person or organisation, or is deliberately false or misleading.
- Is spam, advertising, or a scheme to collect money or personal data.
- Contains malware or links designed to harm devices or accounts.
You must also not:
- Access or try to access another person's account.
- Scrape, harvest or bulk-download data from the app or its services.
- Reverse engineer, disrupt, overload or bypass the security of the app or its servers.
- Use another account to get around a block, suspension or removal.
Reports and moderation
You can report a post from inside the app, and block accounts you do not want to hear from. We review reports and may remove content, limit features, or suspend or remove accounts that break these terms or the law. We may also act on content we find ourselves or are legally required to remove.
We do not review everything posted in advance, and we are not responsible for content that other users post. Where we can, we will tell you if we remove your content or restrict your account.
Grievances
If you have a complaint about content in emberslate, about how we have moderated your content or account, or about these terms, contact us. Our Grievance Officer can be reached at hello@emberfoldlabs.com.
We will acknowledge your complaint within 24 hours and aim to resolve it within 15 days of receiving it. Include your username and enough detail, such as a link or description of the post, for us to find what you are reporting.
Film and TV information
Film and television information in the app is supplied by TMDB. This product uses the TMDB API but is not endorsed or certified by TMDB. Where-to-watch availability is provided by JustWatch, through TMDB.
This information is provided for your convenience and may be incomplete, out of date or wrong. emberslate is a tracking app: it does not stream, sell or host films or TV shows.
Price
All emberslate features are currently free. Pricing may change in the future as the app grows. If we introduce paid features or advertising, we will explain the change before it affects you, and any paid features will come with their own terms of sale.
Changes to the app
emberslate is at an early stage. We may add, change or remove features, and the service may sometimes be unavailable for maintenance or reasons outside our control. We will try to give notice of significant changes in the app.
Deleting your account
You can stop using the app at any time. You can delete your account from inside the app under Settings, or at https://www.emberfoldlabs.com/emberslate/delete-account. Deletion cannot be undone; the Privacy Policy explains what it removes.
We may suspend or close your account if you seriously or repeatedly break these terms, if the law requires it, or if continuing to provide it would expose us or other users to harm.
No warranty
emberslate is provided "as is" and "as available". To the extent the law allows, we make no promises that the app will be uninterrupted, error-free or fit for a particular purpose, or that any information in it is accurate.
Limitation of liability
To the extent the law allows, we are not liable for any indirect, incidental or consequential loss, or for loss of data, profits or goodwill, arising from your use of the app. Our total liability to you for any claim is limited to the amount, if any, you paid us for the app in the 12 months before the claim.
Nothing in these terms limits any liability that cannot be limited by law, or takes away rights you have as a consumer under the law that applies to you.
Governing law
These terms are governed by the laws of India, and the courts of India have jurisdiction over any dispute arising from them. If you live elsewhere, you keep any mandatory protections the law of your country gives you.
Changes to these terms
If these terms change, the updated version will be posted here with a new date. Significant changes will be communicated in the app. If you keep using the app after a change takes effect, you accept the updated terms.
